INSIGHT: VATICAN BANK-MONEY, MYSTERY AND MONSIGNORS

VATICAN CITY, June 8, 2012 (Reuters) ? For a financial institution whose ATMs offer Latin as a language option, whose offices are below the pope's windows and where tellers work under the gaze of crucifixes, one might assume the Vatican bank would have a dispensation from earthly travails.
But new judicial woes and internal upheavals at the bank, officially known as the Institute for Works of Religion (IOR), have raised new hurdles for the Vatican, just as it entered the final stretch of years of efforts to join the international club of financial righteousness.
On May 24, in the type of corporate drama rarely seen in the Vatican, Ettore Gotti Tedeschi, 67, the Italian president of the IOR, stormed out of the bank's executive offices.
He had spoken for 70 minutes non-stop in the boardroom to defend his management but left in a huff when it became clear that the other four board members were intent on approving a no-confidence motion against him.
Gotti Tedeschi, a conservative Catholic who heads the Italian retail unit of Spain's Banco Santander, went to his car in the Sixtus V Courtyard and left the Vatican via the nearby Saint Ann's Gate, receiving a customary crisp salute by a Swiss Guard oblivious to the drama that had just unfolded.
"During the deliberations, at 4:00 p.m., you abandoned the premises of the Institute without notice and without waiting to receive notice as to the results of the no-confidence vote," says a memorandum of the meeting seen by Reuters.
A day after the astonishing arrest of the pope's butler in an affair of purloined documents, and 30 years after a Vatican-linked financier known as "God's Banker" was found hanged from a bridge in London, the last thing the Holy See needed was more headlines about its bank, housed in the 15th-century Tower of Nicholas V, which Pope Benedict can see from his bedroom window.
For the past two years the Vatican, a 108-acre sovereign city-state surrounded by Rome, has been pulling out all the stops to make the "white list" of states that comply with international standards against tax fraud and money laundering.
THE T-WORD
Recently, the T-word - transparency - had become a mantra in the Vatican, which hoped a decision by European financial institutions would soon allow it to put its bank's often murky past behind it for good.
But since May 24, the T-word has been wielded as a weapon by both Gotti Tedeschi and those who showed him the door.
"I have paid the price for transparency," Gotti Tedeschi told Reuters just a few minutes after the no-confidence vote.
Board members who voted him out said the opposite was true.
"Categorically, this action by the board had nothing to do with his promotion of transparency," said Carl Anderson, one of the five external financial experts who make up the board.
"In fact, he was becoming an obstacle to greater transparency by his inability to work with senior management," Anderson, the American head of the worldwide Catholic charity group, Knights of Columbus, told Reuters.
Another person familiar with the matter said: "It was not a question of 'let's plot the demise of this man', as Italian newspapers might lead one to believe. There were many pleas from many people saying, 'Come on, you have to start acting like a president'."
The confidential memorandum listed nine reasons for the move against Gotti Tedeschi. It accused him of failure to carry out basic duties, failing to attend board meetings, "progressively erratic personal behavior" and "exhibiting lack of prudence and accuracy in comments regarding the institute".
But the memo gave a clue to something perhaps more worrying: "Failure to provide any formal explanation for the dissemination of documents last known to be in the president's possession."
The careful wording appeared to be used so as not to accuse Gotti Tedeschi of personally leaking documents but suggesting they may have reached the media through an intermediary.
THE BUTLER AND THE BANKER
Gotti Tedeschi's abrupt departure came one day after Pope Benedict's butler, Paolo Gabriele, was arrested in the most clamorous chapter so far of the so-called "Vatileaks" scandal, in which sensitive documents have appeared in the media since January, including some related to the IOR's transparency bid.
That bid began late in 2010, when the Vatican, the world's smallest state, with around 500 residents, drafted new financial transparency laws and set up internal regulations to make sure its bank and all other departments adhered to international standards on money laundering and terrorism financing.
The move was an attempt to make the "white list" of the Paris-based Financial Action Task Force (FATF), a body that lists states according to their compliance with those standards.
The Vatican established an internal Financial Information Authority (FIA) along the lines of other countries and promised to liaise with the FATF and law enforcement agencies.
But leaked documents appeared to show a conflict among top Vatican officials over just how transparent the bank should be about its dealings before the new laws came into force in 2011.
In one letter, Cardinal Attilio Nicora, head of the new FIA, complained to Secretary of State Cardinal Tarcisio Bertone that a change in the FIA's charter had weakened its oversight powers and could be seen as a step backwards by European authorities.
Both are members of the commission of five cardinals that oversee the bank and its board.
In another setback for the bank, JP Morgan closed the IOR's account in Milan in March this year because it felt the bank had failed to provide sufficient information on money transfers.
A person in the Vatican close to the situation called JP Morgan's action "unjustified and taken after pressure from Italian regulators".

VATICAN BANK?S FORMER HEAD UNDER SHOCK AFTER HOUSE SEARCH: ?I THOUGHT SOMEONE HAD COME TO SHOOT ME?

THE DRAMATIC STATEMENT OF THE BANKER WHOSE HOME IN PIACENZA WAS SEARCHED AT THE CRACK OF DAWN

It was still pitch black in the building's spacious internal court yard, which resembled a Vatican cloister, when Ettore Gotti Tedeschi descended the last step of the enormous flight of stairs, suitcase in hand, and approached his car. He was supposed to leave for Milan before dawn, as usual. A fifty minute car journey, a flick through the newspapers and mass at 8. Then in the afternoon, he was meant to get the train to Rome. Among the letters he had with him, was a memorial he intended to deliver to Benedict XVI: a reconstruction of the recent events that led to his controversial dismissal from the Vatican Bank (IOR).

But when he got to the car, there were four men waiting for him. The warrant officer slipped his hand into his pocket and extracted his police badge. It all happened so quickly that Gotti Tedeschi thought they had come to shoot him.
For a fraction of a second, God?s former banker feared the worst. Then, he was shown a search warrant and told that he would have to change his plans for the day and cancel his trip to Rome. Gotti Tedeschi, with his sallow face, took a quick look at the piece of paper. Then he called out to his wife: ?Francesca!?
The Vatican bank board?s shocking no-confidence vote in Gotti Tedeschi two weeks ago, was followed by a harsh communiqu? that was not in keeping with the Holy See?s style. A document that was both morally and professionally devastating. And now this new unexpected blow. A search warrant was issued but the Vatican bank?s former head was not under investigation.
The investigation being carried out by Naples prosecutors has nothing to do with the Vatican bank saga. ?Fortunately I kept calm when he came in accompanied by three carabinieri (Italian military policemen), looking shocked. I had woken up at four, unable to get back to sleep. I had said the rosary. I was perfectly at peace,? Gotti Tedeschi?s refined and courteous wife told Italian newspaper La Stampa.
The Gotti Tedeschis? home is located right in the heart of the Northern Italian city of Piacenza, in Via Verdi, just a stone?s throw away from the old heart of the city. The sitting room is an art gallery of old paintings on religious themes mostly. On one of the tables there is a photo of their five children and one of the couple attending an Audience with Pope Benedict XVI. To the right, there is a door leading to the banker?s small study.
The triangular, narrow and monastic-like room has a dark wooden desk which is not much larger than an old school desk, with a tiny window in front of it. It is chock-a-block with newspapers, articles, magazines, conference texts and diaries. It was in this cramped room that the Catholic banker set to creating a reconstruction of his three years as President of the Vatican bank, in a memorial that he planned to take to Rome. He did this convinced that his exit was linked to the disputes over the new anti-money laundering laws and the attempts to rescue San Raffaele hospital in Milan.
And this is where the search began. The carabinieri started rummaging through every single piece of paper in the study, looking for any correspondence between Gotti Tedeschi and Giuseppe Orsi. Throughout the search, the carabinieri remained in close telephonic contact with public prosecutor Vincenzo Piscitelli. They eventually found a letter in which the managing director of Finmeccanica (Italy?s leading manufacturer in the high technology sector) expressed his solidarity to Gotti Tedeschi after his sudden dismissal from his position in the Holy See. Gotti Tedesci and Orsi are both from Piacenza, they were both born in 1945 and they have known each other for a long time and share a mutual respect for one another.
The policemen sent by Naples prosecutors opened up Gotti Tedeschis? briefcases containing decades?-worth of meticulously kept check-book stubs. They then opened a small safe where the family?s deeds and a couple of pieces of jewellery were kept.
By the time the sun had risen, the search had briefly moved to the family?s country home in San Paolo, a small village about ten kilometres from Piacenza. But there was no study and no documents were found so the search ended quickly. In the meantime, carabinieri were searching the banker?s Milan office, two minutes away from La Scala opera house, where the headquarters of Banco Santander are located.

VATICAN HITS BACK AT ITALY OVER DOCUMENT SEIZURE

Associated Press= VATICAN CITY (AP) ? The Vatican chastised Italian authorities on Friday for seizing documents intended for the pope during a raid on the home of the recently ousted Vatican bank chief, reminding them that the Holy See is a sovereign state whose officials and documents enjoy immunity protections.
In a statement, the Vatican said it expected that Italian judicial authorities would recognize and respect its internationally recognized sovereign status in any proceedings concerning Ettore Gotti Tedeschi.
Italian paramilitary police raided Gotti Tedeschi's Piacenza home on Tuesday as part of a corruption investigation into Italy's state-controlled aerospace giant Finmeccanica. He is not under investigation, and at the time of the raid prosecutors said the search had nothing to do with Gotti Tedeschi's recently terminated role as president of the Vatican bank.
But during the raid, police seized documentation Gotti Tedeschi had prepared for the pope concerning his controversial May 24 ouster as president of the Vatican bank, known as the Institute for Religious Works.
In an unprecedentedly harsh move, the bank's board fired Gotti Tedeschi in a no-confidence vote, accusing him of leaking documents, failing to do his job and impeding the Vatican's efforts to be more transparent in its financial dealings.
Gotti Tedeschi's lawyer said Thursday the documentation that was seized contained his client's responses to the board's accusations.
The seizure and subsequent questioning by prosecutors about Gotti Tedeschi's role at the bank posed potentially thorny legal issues, since Gotti Tedeschi enjoys some immunity as a former official of a foreign sovereign, the Vatican.
It's not clear what was contained in the seized documentation ? some news reports say there were 47 folders seized. But official Holy See documentation could be considered protected under the Vatican's sovereign status were prosecutors to try to get it admitted in any court proceedings.
Gotti Tedeschi and the IOR's general manager were placed under investigation in 2010 by Rome prosecutors for alleged violations of Italy's anti-money laundering norms in conducting a routine transaction from an IOR account at an Italian bank. Prosecutors seized some ?23 million ($28.97 million) from the account but eventually returned it after the Vatican passed an anti-money laundering law that went into effect last year.
Gotti Tedeschi has long called the investigation the result of a misunderstanding. He hasn't been charged.
Gotti Tedeschi's ouster and subsequent raid on his home has convulsed a Vatican already reeling from the leaks of documents from the pope's desk that ended up in a recently published book, documentation that paints a picture of a Catholic Church hierarchy as little more than a group of petty, provincial Italian bureaucrats engaged in Machiavellian power struggles.
Already the pope's butler has been arrested in the leaks case, accused of keeping papal documents in his Vatican City apartment.
Gotti Tedeschi was named president of the Vatican bank, known by its Italian acronym IOR, in 2009, tapped by the pope's No. 2 to help rid the bank of its reputation as a scandal-plagued tax haven and help get the Vatican on the so-called "white list" of countries that share financial information to crack down on tax evasion.
A critical step in that process is just weeks away with a Council of Europe committee deciding in early July on whether the Vatican has complied with dozens of anti-money-laundering measures. The upheavals of recent weeks have certainly clouded the Vatican's chances.
In the statement Friday, the Vatican repeated that Gotti Tedeschi was ousted for "objective reasons concerning the governance" of the IOR and not because of any opposition to financial transparency "which is at the heart of Holy See authorities and the Institute itself."
It praised the IOR's current staff; Gotti Tedeschi was known to have clashed with the bank's general manager Paolo Cipriani, who remains under investigation in the 2010 money-laundering case.

Holy See makes statement on allegations against Professor Gotti Tedeschi

The Holy See has expressed its ?surprise and concern? at recent events surrounding Professor Gotti Tedeschi (above), the ousted head of the Vatican Bank.
Italian authorities last week seized a private document meant for Pope Benedict XVI when they raided the home of the former head of the board of directors at the Institute for the Works of Religion (IOR)?the formal name for the Vatican Bank.
Mr Tedeschi?s home was raided by Italian paramilitary police last week as part of a corruption investigation into Italy?s state-controlled aerospace giant Finmeccanica. Mr Tedeschi himself is not under investigation, and at the time of the raid prosecutors said the search had nothing to do with his recently terminated role as president of the IOR.
During the raid, however, police seized documentation Mr Tedeschi had prepared for the Holy Father in connection with the confidence vote he faced last month.
?The Holy See was surprised and concerned to learn of recent developments involving Professor Gotti Tedeschi,? the Vatican statement said. ?It has the greatest confidence that the Italian judicial authorities will honour and respect the sovereign prerogatives which the Holy See is recognised as having under international law.

Ettore Gotti Tedeschi feared for his life because his efforts to crack down on alleged money laundering and making the bank's operations more transparent had targeted accounts held by mafia godfathers, the Italian media reported.
The banker was preparing to send a copy of a dossier of letters, emails and other documents that he had compiled to Monsignor Georg Ganswein, one of Benedict XVI's two private secretaries.
He had also requested a private audience with the Pope a few days before he was ousted by the board of the bank on May 24 after three years at the helm of the institution.
He left instructions with his secretary to send two other copies to a lawyer and to a prominent Italian journalist, with notes saying that if anything happened to him, the explanation would be found within the documents.
The secret dossier consisted of 47 binders of documents, including some which related to Mr Gotti Tedeschi's efforts to convince Cardinal Tarcisio Bertone, the Vatican secretary of state and de facto prime minister, of the need to clean up the bank's activities so that the city state could join an international "white list" of financially transparent countries.
Cardinal Bertone allegedly tried to water down some anti-money laundering regulations that Mr Gotti Tedeschi, 67, wanted to adopt, and engineered the banker's dismissal.
The Vatican has denied the allegations and has claimed that it was in fact Mr Gotti Tedeschi who was dragging his feet on the reforms.

Ettore Gotti Tedeschi feared for his life when he was ousted as head of the Vatican bank after a vote of no confidence May 24.
The 67-year-old Italian was brought in by the pope?s secretary of state, Cardinal Tarcisio Bertone, in 2009 with a mandate to turn the troubled bank around and help ?facilitate transparency? with an eye toward quashing rumors that the bank was a den of iniquity. The Vatican had hoped that through Gotti Tedeschi?s guidance, the tiny city-state could finally earn a coveted spot on the global Financial Action Task Force ?white list? of states whose financial practices can be trusted.
In reality, Gotti Tedeschi says he found the bank?s record much worse than he could have imagined, and that he spent the last two years struggling endlessly against the Vatican?s powerful Vatican forces, whom he says blocked his every attempt at transparency. He stormed out of his final meeting of the board of the Vatican bank, known as the Institute for Religious Works (IOR), even before they cast their no-confidence vote against him. The bank says it dismissed him due to lack of management skills and ?progressively erratic personal behavior.? But Gotti Tedeschi says he was ousted because he got too close to the truth about the bank?s alleged shady dealings. He told a Reuters journalist moments after he was sacked, ?I have paid the price for transparency.?
A week after his ouster, Gotti Tedeschi was in trouble again. His home in Piacenza and his offices in Milan were searched by Italian police, who say they were combing for evidence that he was an ?informed witness? with regard to questionable business dealings of Italy?s state-run defense and aerospace firm Finmeccanica, whose president is his close pal. He has not been arrested, nor is he officially under investigation, and the police say the Finmeccanica inquiry is a separate affair not at all related to his problems with the Vatican bank. But in searching his property, investigators reportedly found a treasure trove that could link the Vatican to all sorts of shady dealings and underworld characters. And the Vatican top brass desperately want to get their hands on it, sternly warning Italian police that because the Vatican is a ?sovereign nation? their documents are protected under immunity, even if they are found during a criminal probe outside its borders. ?The Holy See is surprised and concerned at the recent events that Professor Gotti Tedeschi is involved with,? said a Vatican statement issued Friday. ?We have faith that the prosecutors and Italian judicial system will respect our sovereignty?recognized internationally?with regard to these documents.?
What they are reportedly worried about is a secret dossier that Gotti Tedeschi told friends he compiled ?just in case something happens to me.? Local press reports say the dossier includes 47 different binders with emails from the pope, letters from cardinals, and notes and reports from various meetings tied to Vatican bank business. He had reportedly planned to deliver the dossier directly to Pope Benedict XVI, presumably as a counterargument to his May 24 firing. The cache reportedly contains irrefutable evidence that could substantiate claims that the IOR is involved in money laundering and tax-evasive practices. There were documents that allegedly show financial transactions between the Vatican and a number of surprising characters, including politicians and known middlemen for mafia bosses. If true, it would give Italian authorities a rare opening to investigate the Vatican?s banking practices with names, account numbers, and transaction dates of dealings with financial entities outside the Vatican?s historically secretive jurisdiction.
